How Much Can I Get From my Car Accident Settlement?

If you’ve been injured in a car accident, you may wonder what your settlement is worth and how much you will end up with in your pocket. Just to be clear, there is no specific formula in order to determine exactly what your case is worth, but there there is a general formula upon which the insurance companies and lawyers rely to help determine the value of the case:
- Past medical bills
- Future medical bills
- Past lost wages
- Future lost wages
- Pain and suffering damages
Total value of your accident
Most of the above criteria are known as “special damages” and can be calculated specifically down to the penny, but the pain and suffering damages are known as “general damages” and are more difficult and abstract in their calculation. The specific value has many factors that are weighed when trying to come up with an actual amount: suffice it to say this is why it is important to have a good lawyer at your side to help you fight for the highest value for your pain and suffering along with making sure all of the medical bills are compiled appropriately to determine there absolute calculation.
After an amount is calculated that all parties can agree upon, the attorney’s fee, medical liens and other out-of-pocket expenses must be considered before the client will know what they are getting specifically as their net settlement. Generally the attorneys fee is a third of the settlement: after the medical liens and any money that is owed to health insurance the Balance that remains will be the clients net settlement.
